These terms describe our text messaging program: what messages you may receive, how to opt in and out, and how we handle your mobile number.
1. Program Name
UpState Hearing Instruments Appointment and Patient Notification SMS Program.
2. Program Description
By providing your mobile phone number and opting in, you agree to receive recurring automated text messages from UpState Hearing Instruments. These messages may include:
- Appointment confirmations, reminders, and scheduling changes
- Callback request responses and follow-up after a hearing evaluation or fitting
- Notifications that hearing aid repairs, orders, batteries, or supplies are ready for pickup
- Office closures, schedule changes, and similar service notices
- Billing, financing, and payment notifications
- Occasional promotional offers
Messages are sent using automated technology. Your consent to receive text messages is not a condition of purchase or of receiving any service or care from us. You are not required to opt in to do business with us.
3. Message Frequency
Message frequency varies based on your interactions with us. You may receive several messages in connection with a single appointment, fitting, or repair. We will not send messages beyond what is reasonably necessary for the purpose you opted into.
4. Message and Data Rates
Standard message and data rates may apply, depending on your wireless carrier and mobile plan. We are not responsible for any messaging or data charges incurred through your mobile provider.
5. How to Opt In
You may opt in to receive text messages from us by:
- Checking a text message consent checkbox on a form on our website. The checkbox is unchecked by default and is separate from any email opt-in.
- Submitting a form where text message consent language is clearly displayed at or above the submit button
- Providing your mobile number with consent on an intake or patient form at any of our offices
- Providing your mobile number in person or by phone and explicitly agreeing to receive text messages
- Texting us first at [INSERT SMS-ENABLED NUMBER]
By opting in, you confirm that you are the mobile account holder or have the account holder’s permission to provide that number, and that you are at least 18 years of age.
Consent to receive text messages is not required as a condition of purchasing any goods or services from us, or of receiving care.
6. How to Opt Out
You may opt out at any time using any of the following methods:
- Reply STOP to any text message from us
- Reply CANCEL, QUIT, END, or UNSUBSCRIBE. Any standard opt-out keyword will unsubscribe you.
- Contact us by phone at (530) 243-7307, by email at [INSERT CONTACT EMAIL], in person at any of our five offices, or by any other reasonable means
After opting out you will receive one final message confirming your unsubscription, and no further messages unless you opt in again.
We honor opt-out requests as soon as practicable, and in no event later than ten business days after receipt, as required by applicable law. We do not designate any single opt-out method as exclusive. You may revoke consent by any reasonable means.
Opting out of text messages will not affect your care or your ability to do business with us. If you opt out, we will contact you by phone or mail instead. Please make sure we have a current phone number and mailing address so you do not miss important information about your appointment or your hearing aids.
7. Help
Reply HELP to any text message from us, or contact us at (530) 243-7307 or [INSERT CONTACT EMAIL].
8. Supported Carriers
Text message delivery depends on your mobile carrier’s network. Service may not be available on all carriers and delivery is not guaranteed. We are not liable for delayed, undelivered, or misdirected messages resulting from carrier issues, network interruptions, technical limitations, or other circumstances outside our reasonable control.
Major carriers include but are not limited to AT&T, T-Mobile, Verizon, US Cellular, and regional carriers.
9. Privacy and Data Use
Personal information collected through our text messaging program is handled in accordance with our Privacy Policy. Protected health information is handled as described in our Notice of Privacy Practices.
We do not sell, rent, or share your mobile phone number or your text message opt-in consent with third parties or affiliates for their marketing purposes. Mobile information will be used only to provide the communications you have requested or as required by law.
All categories of data sharing described in our Privacy Policy exclude text messaging originator opt-in data and consent. This information will not be sold, rented, or shared with any third party for their marketing purposes.
10. Health and Safety Notice
Do not use text messaging for emergencies. If you are having a medical emergency, call 911 or go to the nearest emergency room. Text messages are not monitored around the clock and we cannot guarantee a timely response.
Text messaging is not a secure channel. Standard SMS is not encrypted and can be read by anyone with access to your phone. We keep health information in our messages to a minimum, but we cannot guarantee the confidentiality of a message once it leaves our system. If you would prefer that we not send appointment or care-related information by text, tell us and we will contact you by phone or mail instead.
Please do not send detailed medical information, insurance identifiers, or payment card information by text. Call the office instead.
Text messaging does not replace a clinical appointment. Messages from our team are not a diagnosis and are not a substitute for a professional hearing evaluation.
11. Changing or Transferring Your Number
If you change or give up your mobile number, please notify us promptly by calling any of our offices. If you do not, messages intended for you may be delivered to whoever receives that number next. You agree to notify us of any change so we can keep our records current.
